Beware: Web site thief
« on: February 03, 2021, 11:15:35 AM »
Hi

I am really ****** off...
www.keyboardlovers.nl has STOLEN at lot of my web pages, e.g. http://www.keyboardlovers.nl/The-Unofficial-YAMAHA-Keyboard-Resource-Site/My-Software/ and http://keyboardlovers.nl/The-Unofficial-YAMAHA-Keyboard-Resource-Site/Software-1/
The first has the heading "My Software". Yes it is mine, NOT his.
The page code from my pages are copied directly into his template. Shame on him!
Compare the two examples to http://www.jososoft.dk/yamaha/software/software.htm and http://www.jososoft.dk/yamaha/software.htm
I am so angry.
This is not fair - and it is illegal...
I have asked him to remove everything he has copied from my site.
Anyone is free to LINK to my site, not to COPY.

Jorgen,

That stinks, is there anything you can do to make him take down your stolen content, besides ask him?

Do you have a lawyer friend that could just send a letter threatening a lawsuit for copyright infringement?

It's not fair for you to do all the work and for him to take credit, I would be mad too!

Good Luck,

Rick D.

I think you need to add paid ADS to you all your pages. Who knows how many other people have linked to your pages. You ought profit from your site in that manner.  ;)

I see that this fellow has some paid ADS on his pages.

That is not good.

If it's any consolation - and it probably isn't - I see they have also stolen content from other sources, for example 'Tyros Tipsters".

I would expect them to get a few nasty letters in the post soon.

Hi Jørgen, ...all my solidarity
Could you modify your site, with a welcome page, with login, to allow access only to members? (we'll are all happy to sign up us and login)  That is, do not allow the download of your programs if not through login . Could you block links to your work in this way?

Hi Jørgen.

I can see that all links at that page point to your site, so it may be a slight chance that the site admin did not 'steal' your site on purpose, but simply copied whitout think any further other than it could be an easy way to the visitors to download your software.
But yes, a descriptin of your site, and a link to your frontpage would be a far better solution, as well as a much more fair way to do it.

Happy new year, keep well and stay safe. 🍻
Cheers 🥂

Hello Jorgen —

Just want to offer my encouragement and support. It takes a lot of work to develop and post quality software and content. ( I don’t need to remind you.  ;) ) It really stinks when people rip off your work without attribution, at the very least.

I hope you can find a resolution.

We got your back  — pj

Hi
My stolen content has now been removed from www.keyboardlovers.nl

I have discussed the case today with my lawyer and the case is fully lit as a violation of national and international copyright laws. He asked me to wait a short time to see if the case would be resolved as legal action would inevitably incur costs.

I might add that on October 26, 2016, I discovered exactly the same thing that has happened now. At that point the webmaster finally deleted all my content but apparently he is posting it on his web site again after some time. He really is very uneducated!

Thanks for the support from all of you!

Hi Norman

At the moment there is nothing more to do, but thanks for your offer.

I wonder if  SoundWonderland and Tyros Tipsters are aware of this matter. If their content is used without permission of course.

It is of course free for anyone to create a web site with the same information that I have created on my web site. But it is forbidden to directly steal other people's intellectual work. Copyright laws cover all media: literature, design, art, film, music, software, etc.

It’s a bit annoying, but not very damaging. He hasn’t stolen any actual software. And it’s hard to see much more than very minor benefit for him. Might make his website seem a bit ‘fatter’  with no effort, but not much more than that. Certainly not worth chasing after at your cost. The limited action you took seems perfectly appropriate. My own guess is that he made a mistake rather than some evil intent.

Copyright infringement has nothing to do with "damages" in a court of law.  ;)

If convicted an infringer can be expected to pay thousands per infringement.

Amounts paid out for infringement are separate and paid out "in addition" to damages.

The two are totally separate.

Just the fact that he did it before back in October, and again now "bugs" me.

Could be it's just a matter of time before he does it again?!

Agreed. “Damages” is legal a legal term which I did not use. Damage or damaging are not legal terms and mean something completely different. And to clarify for others, Copyright infringement is about unauthorized use. The items are not ‘stolen’ because they remain in control or possession of the owner.
